☆TERMS OF SERVICE☆

▼Please have read all the Rules/Terms Of Service as listed below in regards of
what you are looking to commission me for before proceeding.▼

▶By commissioning me, it means you have read and accepted these terms▶You must be 18 years old or older to commission work from me.▶Please credit me if the commission is posted or used anywhere, to my Twitter @Emini332 or my twitch twitch.tv/Emini332▶All artworks are for personal use. If you are interested in commercial work (Twitch, Youtube, etc) please read further below for commercial use info.▶You CANNOT edit my art, nor remove any watermark.▶ There are absolutely no refunds when I start working on your commission. If you are not satisfied with the piece I will NOT give refunds or redo the piece, however, if I have missed minor details that have already been agreed to and you would like me to add them in, I will do my best to do so.▶ Please note that at this time I do not create OCs/Designs for people solely from the description alone(Unless stated otherwise beforehand),
Reference of what you'd like your Character to look like is required for my commissions.
A Pinterest board or photo reference is preferred.▶ Payment is upfront and I will not start on a commission until I have 100% looked through and accepted your Commission Form Request, to which I will then send you an invoice via PayPal asking for said upfront payment. I will not start on a commission until you have been informed and payment has been received in full upfront.▶ I reserve the right to refuse the request of a commission if I feel I cannot execute it properly and/or it makes me uncomfortable to take on in any way.▶ You may not resell my artwork, or my models, use them commercially, or for promotion of a commercial project unless we have discussed and agreed on this usage.▶ You may NOT remove my signature from the commissions I place it in. Certain commissions such as EXAMPLE: Pngtubers do not bear my signature, but credit is required on your channel/page.▶ Finished work will be sent as a PNG file to you. Layered or.CLIP files will not be given for the piece.
Vtuber models are the exception to this rule as stated in the rules in their section.▶ The artist retains the right to post the work to any site of they’re choosing when the piece is finished or prior unless stated otherwise by myself, including live streams and process recordings to YouTube and/or anywhere else. These will include any reference images you have given me potentially.▶ Only watermarked screencaps will be sent over for approval/checks until the piece is finished in which the approval watermark will be removed in the final finished piece you receive.▶ Extra may be charged for any sudden major changes to the concept agreed on after I have received your approved form & full payment.▶ You may not claim my artwork as your own, trace, or heavily reference my work and claim it as your own.▶ Should there be any reason I cannot finish a piece, I will offer you the work that I have done for the price it would amount to with a refund for the remainder of the cost of work not completed.▶ Once the commission is completed, I will send/email the completed file(s). Once received, the file is the responsibility of the commissioner. While the artist keeps copies of completed commission files, they are not responsible for replacing or resending files should they be lost. It is strongly recommended that you the commissioner backup the file(s) once received.▶ The work may not be used to attack or marginalize anyone. If this is the case, the artist retains the right to have you remove the artwork from anywhere you are using it. If you do not remove the artwork after being asked, The artist will contact the platform or service it is being used on to have it removed.▶The secret "I read the tos!" password for this form is Sweet Potato.
Please enter it on the form.▶ Clients, under any circumstances, are not permitted to use the commissioned artwork for non-fungible tokens (NFTs). Use of the artwork for any kind of profit, including, but not limited to, non-fungible tokens or cryptocurrency is strictly prohibited.

☆Commercial use info☆

▶All terms are the same as the general terms, however, commercial use commissions are more strict.▶Ordering a commission with commercial use in mind applies to using the artwork for YouTube, Twitch, etc. (Such as video thumbnails, edits, emojis, etc.)▶It also applies to reproducing the art in any way that is primarily intended for or directed toward commercial advantage or monetary compensation. Such as reselling the art in poster form instead of having it personal to yourself.▶Using the image as an icon for social media, or for personal use only of the like is not considered a commercial use. In the case of streamers in general (YouTubers, etc), reposting and using the art as advertisement on social media platforms thus gaining revenue in some manner would be considered for commercial use.▶example types of commercial use being but are not limited to: artbooks, events, prints, animations, videos etc.
Reselling of my work is not allowed in any form unless discussed and worked out with some manner of a commercial use fee.▶ This is also mainly applied to my artworks/designs, vtuber models are most definitely for commercial use but are fine to be out of this specific area as long as I am always credited for the model's creation/design or rig, everything else applies to this area so please consider carefully!▶If these terms are not followed or respected, offenders will be immediately blocked and blacklisted from commissioning me again.▶If you have any further questions don't be afraid to ask, for if you commission me with commercial use in mind and do break a term without fully understanding, I would assume you understood everything written in the terms- ending in the previous bullet point.

I work on my commissions live on my Twitch Channel usuallly!

There is an opt-out of this on every form.
but note that Not all pieces will be live-streamed considering I cannot account for when or how long I can stream per stream and/or if you fill out private within the form you fill out.
(My Discord has a new schedule every week.)
(Notes: I always try to plan and message those who's the commission is going to be worked on and give them time to catch the stream ahead of time but sometimes I do get busy.)
